These Terms and Conditions (the “Terms”) govern the short-term holiday rental of the property known as “Villa Luce”, located at Via Diano Calderina 11, 18100 Imperia (IM), Italy, between the property owner (the “Owner”) and the customer making the reservation (the “Guest”). By completing a booking and ticking the acceptance box, the Guest declares having read, understood and fully accepted these Terms, as well as the Privacy Policy and Cookie Policy published on the website.
1. Booking and confirmation
The reservation is finalised when the Owner sends the confirmation email to the Guest, following the successful completion of the first payment (or its authorisation) via the Stripe gateway. The Guest must provide accurate personal data and a valid email address; any errors in the data provided are the Guest’s sole responsibility. The Owner reserves the right to refuse or cancel bookings that are manifestly incorrect, fraudulent or incompatible with the actual availability of the property, with a full refund of any amount already paid.
2. Prices, payments and 30/70 split payment
Prices displayed on the website are in Euros, per stay, and include all applicable taxes with the exception of the municipal tourist tax (see article 11). The total price includes the cost of the nights, the mandatory service fee, any selected extras (additional linen change, crib, etc.) and any applicable promotional discount.
- If the booking is made more than 30 days before arrival, 30% of the total is due as a deposit by the date shown at booking; the remaining 70% is due 30 days before arrival.
- If the booking is made 30 days or less before arrival, the full amount is due by the date shown in the confirmation.
- The Guest may choose card payment, securely handled by Stripe and charged according to the deadlines, or bank transfer, to be made manually by the same deadlines using the bank details and reference sent by email.
- Automatic reminders are sent for bank-transfer deadlines. If payment is not regularised within 3 days, the booking may be cancelled for the Guest’s default and any deposit already paid retained.
3. Damage penalty — authorisation to charge up to €500.00
No security deposit is blocked online at the time of booking. By accepting these Terms, the Guest expressly authorises the Owner, pursuant to Italian Civil Code art. 1341 and to Stripe rules for Merchant-Initiated Transactions (MIT), to charge the same payment card used for the booking up to a maximum of €500.00 as a contractual penalty, in the following cases:
- Damage to furniture, appliances, linen or the property, beyond normal wear and tear.
- Need for extraordinary cleaning due to significantly worse conditions than reasonable use (stains, burns, persistent bad smells, etc.).
- Failure to return keys or any devices (remotes, badges).
- Serious breaches of the house rules (unauthorised parties, exceeding maximum capacity, smoking indoors).
- Documented restoration costs incurred by the Owner to bring the property back to its original condition.
4. Check-in, check-out and guest registration
Unless otherwise agreed in writing, check-in is between 4:00 PM and 8:00 PM on the arrival day and check-out is by 10:00 AM on the departure day. Check-in is carried out in person by the Owner or a designated representative. Pursuant to Italian law (D.L. 59/1978 and subsequent amendments), the Guest and all members of the party over the age of 14 must present a valid ID; the data will be transmitted electronically to the competent Police Authority within 24 hours of arrival. Refusal to present a valid document will result in the impossibility of completing the check-in, with no right to a refund.
5. Maximum capacity and composition of the party
The maximum capacity of Villa Luce is 6 people, spread over 3 double bedrooms (max 2 guests per room). It is not permitted to host more people than indicated in the reservation, nor to bring into the property people who were not registered at check-in, without the prior written consent of the Owner. Failure to comply constitutes a serious breach of contract and entitles the Owner to terminate the contract with immediate effect, without any obligation to refund, in addition to charging the penalty referred to in article 3.
6. Cancellation and change policy
Unless different specific conditions are indicated at the time of booking, the following policy applies:
- Cancellation more than 60 days before arrival: 30% of the total (deposit) is retained.
- Cancellation between 30 and 60 days before arrival: 50% of the total is due.
- Cancellation less than 30 days before arrival or no-show: 100% of the total is due.
- Requests to change dates, where technically possible based on calendar availability, will be assessed in good faith by the Owner; any tariff differences will be borne by the Guest.
- Purchasing a travel cancellation insurance policy is strongly recommended.
7. Included services and paid extras
The rental fee includes: ordinary consumption of electricity, water, gas and heating/air conditioning; Wi-Fi connection; bed and bathroom linen for the first week; welcome kit; weekly mid-stay cleaning for stays longer than 7 nights (where included in the rate). A mandatory service fee (covering final cleaning and the initial linen set) is highlighted in the summary before confirmation. Paid extras include: additional linen sets (€25.00 per set per person), baby crib (€50.00 per stay) and any other extra services agreed directly with the Owner.
8. House rules
The Guest undertakes to use the property with due diligence and to comply with the following rules:
- Smoking is strictly prohibited in all indoor areas of the property; it is only allowed outside using the ashtrays provided.
- It is forbidden to organise parties, events or gatherings with unregistered people without the prior written consent of the Owner.

- Promptly report to the Owner any faults, malfunctions or damage observed.
- Use appliances and installations correctly, following the instructions provided on site.
- Do not move furniture between rooms unnecessarily and return it to its original position on departure.
9. Swimming pool — use and safety
The private salt-water pool with counter-current swimming system is reserved for the exclusive use of registered Guests and is used independently, under the users’ personal responsibility. Access by minors is only permitted under the constant and direct supervision of an adult. No lifeguard service is provided. Diving is prohibited, as is bringing glass objects into the pool area and using the pool during storms or after sunset. The Owner is not liable for accidents resulting from improper use or failure to comply with these rules.
10. Pets
Pets are welcome only by prior written agreement with the Owner at the time of booking; a cleaning supplement may be required. Pets must be up to date with their vaccinations, cannot be left alone inside the property and are not allowed in the bedrooms or in the pool. The Guest is responsible for any damage caused by the pet.
11. Tourist tax
The tourist tax established by the Municipality of Imperia is payable by the Guest at a rate of €3.00 per person per night, up to a maximum of €30.00 per person per stay. The tax is not included in the price displayed on the website and is collected directly on site by the Owner upon arrival or departure, with a regular receipt. Any exemptions provided for by the municipal regulation (under 14 years of age, etc.) will be applied upon presentation of a suitable document.
12. Force majeure and exceptional circumstances
Neither party shall be liable for the failure or delay in the performance of its obligations due to causes of force majeure, including but not limited to: natural disasters, fires, floods, epidemics or pandemics, orders of the authorities, strikes, wars, acts of terrorism, interruption of essential services not attributable to the Owner. In such cases, where the stay is objectively impossible, the Owner will offer the Guest the possibility of rescheduling the reservation to a future date by mutual agreement, or a refund of the amount paid, less any non-recoverable costs already incurred.
13. Liability and insurance
The Owner is not liable for the Guest’s personal items that may be lost, stolen or damaged during the stay, except in cases of wilful misconduct or gross negligence. It is recommended to keep valuables in the safe, where available. The Guest is jointly and severally liable with all members of the party for any damage caused to the property, furniture, installations or third parties during the stay, unless proven otherwise. The purchase of an individual civil liability insurance policy to cover such events is recommended.
14. Privacy, complaints, applicable law, jurisdiction and contact
The Guest’s personal data are processed in compliance with Regulation (EU) 2016/679 (GDPR) and with the Privacy Policy published on the website. Any complaints or disputes relating to the stay must be communicated to the Owner in writing within and no later than 7 days from check-out, to the address villaluce@villaluce.it.
